These Terms of Service (“Terms”) govern your participation in the Salesflare Partner Program (“Program”), which allows you to promote the Salesflare software as a service (“SaaS”) product (“Product”) through affiliate links. By participating in the Program, you agree to be bound by these Terms.

To participate in the Program, you must be 18 years of age or older and have a valid email address. You may not participate in the Program if you are an employee of Salesflare or a related company.

As a participant in the Program, you will receive a unique affiliate link (“Link”) that you can use to promote the Product. You must use the Link in accordance with these Terms and all applicable laws.

You will receive a commission on the subscription fee paid by customers who sign up for the Product through your Link (“Commissions”). The Commission rate and payment terms will be determined by Salesflare and may be changed at any time in Salesflare’s sole discretion. It’s currently set at 30% on all lifetime subscription fees. Pay-out of commissions pay-out is organized by Partnerstack, Salesflare’s affiliate software.

You may not engage in any of the following prohibited conduct:

Salesflare may terminate your participation in the Program at any time, for any reason, with or without notice to you. Upon termination, you will no longer be eligible to receive Commissions and must immediately cease all use of the Link and any promotion of the Product.

The Program, the Link, and the Product are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied. Salesflare makes no representations or warranties with respect to the Program, the Link, or the Product, and disclaims all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

You will indemnify, defend, and hold harmless Salesflare, its affiliates, and its and their respective directors, officers, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses arising from your participation in the Program or your use of the Link or the Product.

Any disputes arising from or relating to these Terms or the Program will be resolved through the courts of Antwerp, Belgium, in accordance with Belgian law.

These Terms will be governed by and construed in accordance with the laws of Belgium, without giving effect to any conflict of law principles.

Salesflare may modify these Terms at any time, with or without notice to you. Your continued participation in the Program after any such changes indicates your acceptance of the modified Terms.

You may not assign these Terms or transfer any rights to participate in the Program without the prior written consent of Salesflare. Salesflare may assign these Terms or transfer any rights to participate in the Program without your prior written consent.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

The failure of either party to enforce any rights under these Terms will not constitute a waiver of any rights.

The headings in these Terms are for convenience only and have no legal or contractual effect.

These Terms, together with the Program Guidelines, constitute the entire agreement between you and Salesflare regarding the Program and supersede all prior agreements and understandings, whether written or oral, relating to the Program.

The provisions of these Terms regarding Eligibility, Commission, Prohibited Conduct, Termination, Disclaimer of Warranties, Limitation of Liability, Disputes, Governing Law, Changes to the Terms, Assignment, Severability, No Waiver, Headings, Entire Agreement, and Survival will survive any termination of these Terms.
